Golden Scoop Contest: Terms & Conditions

The following terms and conditions (“T&Cs“/ “Terms and Conditions“) governs the MB Golden Scoop Contest (the “Contest“) organized by Bright Lifecare Private Limited (the “Company“) on www.muscleblaze.comMuscleBlaze App (the Platform“).     

To participate in the Contest, please read these Terms and Conditions carefully. By participating in the Contest, you are deemed to have accepted these Terms and Conditions, which shall govern all the matters related to the Contest. The Company may, in its sole discretion, add to or modify these Terms and Conditions at any time.  Any such additions or modifications will be deemed to have been accepted by you and shall be effective immediately. 

By participating in the Contest, you represent and warrant that you are 18 years of age or older, and that you have read, understood and agree to the Terms and Condition.

PURPOSE:

The Contest is purely a promotional event. You can participate, voluntarily, with your own free will and choice between August 26, 2024, at 12:00 AM, to August 30, 2024, 11:59 PM (the “Contest Period”). 

ELIGIBILITY:

  • The Contest is valid for Indian residents only, who have attained the age of 18 (Eighteen) years. 
  • You are not eligible to participate:
  • if you are an employee, or first degree of relative of an employee, of the Company;
  • If you are directly associated, in any capacity, with the Company;     
  • You are subject to criminal investigation(s); 
  • If you are found to be engaged in any fraudulent activity(ies); 
  • If you provide any false or misleading information; 
  • If you do not comply with these Terms and Conditions; 
  • Failure of verification of the information provided; 
  • If your participation has potential to adversely impact reputation or goodwill of the Company; or 
  • Any other ground as the Company may determine in its own discretion.  
  • The Company reserves the right to cancel your participation at any time during the Contest if any of the ground mentioned in Point No. 2 above becomes applicable to you.   
  • Only purchases made during the Contest Period from the Platform shall be considered for the Contest.

PARTICIPATION RULES:

  • To participate in the Contest, you shall be required to purchase any Muscleblaze Biozyme Protein (the “Product”) only from the Platform during the Contest Period.
  • Upon receipt of the Product, you shall check inside the Product for a gold colour scoop (the “Golden Scoop”). If you find the Golden Scoop inside the Product, you shall contact the Company at [email protected] within 48 hours from the time of receipt of the Product by you. If you fail to contact the Company in the aforesaid manner and timeline, you shall not be considered for the Prize (defined hereinafter).   

When you write an email to the Company informing about the receipt of the Product with Golden Scoop, such an e-mail shall be from your registered email id and must contain your full name, address where the Product was delivered, current residential address, phone number (registered with Muscleblaze), image of the Golden Scoop, an attachment of proof of purchase (order invoice PDF or screenshot) and clear pictures of the Product covering the Batch No. & IVM sticker (Note: For Batch No. – See back of pack near MRP; For IVM – Anywhere on the jar/tub/box, code starts with “IVM-********”).

  • If you fail to provide any of the aforesaid information or the information furnished by you is not upto the satisfaction of the Company, the Company reserves, at its sole discretion, the right to not consider you for the Prize.     
  • In case you order the Product from the Platform during the Contest Period for a third person, you shall be considered to be a participant in the Contest and not the person for whom the Product was ordered. 

SELECTION OF WINNERS AND PRIZE:

  • The winner(s) of the Contest, if any, shall be announced on the Company’s Instagram page i.e., https://www.instagram.com/muscleblaze/?igsh=MWIwdmFtMG5zc3c4NA%3D%3D&utm_source=qr by the Company, within 30 days from the end date of the Contest Period. Decision of the Company regarding selection of winner(s) shall be final and binding. 
  • The winner(s) of the Contest shall be entitled to claim one (1) year stack of worth Rs. 1,00,000/- (Rupees One Lakh only) of any of the products of MuscleBlaze, subject to the limit of Rs. 8,333/- (Rupees Eight Thousand Three Hundred and Thirty-Three only) per month (the “Prize”). To enable a winner to claim the stack, the Company shall provide 12 codes having value of Rs. 8,333/- (Rupees Eight Thousand Three Hundred and Thirty-Three only) each. Each code shall have a validity period, and a winner can use the code within that validity period only. A code can be used only once, and a winner cannot use the code for multiple transactions. The code will be applicable on the MRP of the products displayed on the Platform. MRP of the products is subject to change, and that the Company does not give any representation and guarantee that MRP displayed on the Platform at a given time shall always be the same. Any such representations or warranties, express or implied, are hereby expressly excluded.  
  • Once the Company provides codes to a winner, he/she assumes all responsibility for safe use of the codes. The Company (including its directors, officers, employees and agents) disclaims all liability for any loss or damage resulting in any way out of the leakage or loss of code by the winner(s).

OTHER TERMS:

  • By taking part in the Contest, you give your consent to the Company to contact you via phone, text message or email for various matters related to the Contest. You also give your consent to the Company to use your information available with the Company for various matters related to the Contest, including, but not limited to, current and future marketing and promotion. 
  • All winners of the Contest are subject to verification, including, without limitation, verification of eligibility through checks as deemed appropriate by the Company. The Company reserves the right to verify the winners’ details either on its own or through any third-party agency. Winners shall provide all necessary assistance as may be required by the Company in verification. As a part of process of verification, the Company or third-party agency may ask the winner to provide any documentary or other form of evidence as it may deem fit in its sole discretion. 
  • All taxes, levies and charges on the Prize (if any) shall be borne by you.  
  • All costs and expenses incurred by you to participate in the Contest and/or to claim the Prize shall be solely borne by you, and the Company shall not be liable for any such costs and expenses.
  • Prize is non-transferable and are on an ‘as is’ basis. No cash claims or any other claims, whatsoever, can be made in lieu of the Prize.
  • In case you are not contacted by the Company, it shall automatically mean that your name has not come through the selection process, and you are  not a winner.
  • When you purchase the Product from the Platform, you shall also be governed by other terms and conditions generally available on the Platform.  
  • The Company reserves the right to modify, suspend, cancel or terminate the Contest at any time in its sole discretion, and the Company shall not be liable for any loss or damage or pay compensation for any such modification, suspension, cancelation or termination of the Contest. 
  • Decision of the Company in respect of any of the matters of the Contest shall be final and biding.

LIMITATION OF LIABILITY: 

  • The Company (including its directors, officers, employees and agents) disclaims all liability for any loss or damage resulting in any way out of the Contest, these Terms and Conditions and/ or the Prize, whether direct, indirect, special, or consequential, with the exception of any liability that cannot be excluded by law. 
  • You understand and confirm that the Company cannot be held responsible for any injury or harm of any nature that may occur during the Contest. You agree to assume all risks associated with participating in this Contest and the Prize, including but not limited to the risks of physical injury and harm of any nature. 
  • The Company or any independent third party involved in administering and providing services for the Contest further explicitly disclaims any and all liability for any of the followings: 
  • Errors, mistakes or inaccuracies of the Contest;
  • The acts or omissions of the Company’s representatives performing services on its behalf; or   
  • any loss or damage arising out of your failure to adhere to the obligations under the Terms and Conditions. 
  • You agree that the Company shall not be liable for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, use or misuse of any Prize (except any liability which may not be excluded under applicable law). Regarding the Prize, the Company provides no assurances and explicitly disclaims any guarantees or warranties of any kind. The only option open to a winner in the event of dissatisfaction with the Prize is to stop utilising it. The winner agrees and acknowledges that the use of the Prize shall be at his/her sole risk.

SEVERABILITY:

If any terms and conditions of the Contest are found to be unlawful, void or for any reason unenforceable, then that condition will be deemed severable from these Terms and Conditions and will not affect the validity and enforceability of any remaining Terms and Conditions, unless it is practically not possible to administer the Contest.

REPRESENTATIONS AND WARRANTIES:

You represent and warrant that:

  • All information provided by you is true, correct, accurate and complete.
  • You shall not post any image, story and content at any platform, which/ whose: 
  • Causes annoyance or inconvenience to the general public about the Contest; 
  • Deceives or misleads the general public about the Contest; 
  • Are adverse, offensive or derogatory reference to the Company or its brands; 
  • Presentation, dissemination or disclosure whereof infringes any patent, trademark or any intellectual property rights of the Company; 
  • Are declared by the Company, acting in its sole discretion, to be opposed to standards of morality or decency or to be opposed to public policy or to the Company’s internal code of conduct or other policies/ guidelines adopted by the Company;
  • Gives ground for action for defamation or misrepresentation.

PRIVACY:

  • You hereby provide your consent for collection, storage, use, transfer and retention of your personal information and sensitive personal data or information as defined under the Information Technology Act, 2000 and the rules and regulations promulgated thereunder including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 as may be amended from time to time (collectively, “Personal Information“). 
  • You understand and agree that your Personal Information is being collected by the Company pursuant to these Terms and Conditions in connection with the Contest and it is necessary for the Company to collect the Personal Information for the Contest, and the usages set out in these Terms and Conditions.
  • Aforesaid terms and conditions are subject to your rights available to you under the applicable privacy laws.

INTELLECTUAL PROPERTY:

All right, title and interest, including, but not limited to, in the Contest, intellectual property rights, promotional material(s) and all the responses received shall vest solely and exclusively with the Company at all times.

GOVERNING LAW AND DISPUTE RESOLUTION: 

  • These Terms and Conditions shall be governed by and interpreted and construed in accordance with the laws of India. 
  • If you have a grievance or concern in respect of the Contest, you shall first email the details of the same at [email protected]. The Company shall endeavour to address your grievances or concerns in the best possible manner.  
  • In case an amicable dispute resolution is not possible, the courts of Delhi shall have exclusive jurisdiction to entertain any dispute that may arise in relation to the Contest and/ or these Terms and Conditions.
